1. Definitions
- Consumer: A natural person acting for purposes outside their trade, business, craft, or profession.
- Distance Contract: A contract concluded between Arzeni and the Consumer under an organized distance sales scheme without the simultaneous physical presence of the parties.
- Right of Withdrawal: The Consumer's right to withdraw from the Distance Contract within a specified period.
2. Applicability
These Terms of Service apply to every offer made by Arzeni and to every Distance Contract concluded between Arzeni and the Consumer.
3. Products
Arzeni offers perfumes and related products for sale through its online platform. All products are subject to availability. Product descriptions and images are provided for informational purposes and may not represent the exact appearance of the product.
4. Ordering Process
To place an order, the Consumer must follow the ordering procedure on the website. Arzeni reserves the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in the description or price of the product, or errors in the order.
5. Prices and Payment
All prices are listed in euros (€) and include applicable VAT. Payment must be made in full at the time of ordering using the payment methods provided on the website.
6. Delivery
Arzeni will deliver the products to the address provided by the Consumer during the ordering process. Delivery times are estimates and not guaranteed. Arzeni is not responsible for delays caused by third-party delivery services.
7. Right of Withdrawal
Consumers have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day the Consumer receives the goods.
To exercise the right of withdrawal, the Consumer must inform Arzeni of their decision to withdraw from the contract by an unequivocal statement (e.g., a letter sent by post or email).
8. Effects of Withdrawal
If the Consumer withdraws from the contract, Arzeni shall reimburse all payments received from the Consumer, including the costs of delivery (except for supplementary costs resulting from the Consumer's choice of a type of delivery other than the least expensive type of standard delivery offered by Arzeni), without undue delay and in any event not later than 14 days from the day on which Arzeni is informed about the Consumer's decision to withdraw from the contract.
Arzeni will carry out such reimbursement using the same means of payment as the Consumer used for the initial transaction, unless the Consumer has expressly agreed otherwise; in any event, the Consumer will not incur any fees as a result of such reimbursement.
Arzeni may withhold reimbursement until it has received the goods back or the Consumer has supplied evidence of having sent back the goods, whichever is the earliest.
9. Return of Goods
The Consumer shall send back the goods or hand them over to Arzeni, without undue delay and in any event not later than 14 days from the day on which the Consumer communicates their withdrawal from the contract to Arzeni. The deadline is met if the Consumer sends back the goods before the period of 14 days has expired.
The Consumer will bear the direct cost of returning the goods.
10. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply to the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery. Therefore, Arzeni will only accept returns of perfumes if the warranty seal is intact.
11. Warranty and Liability
Arzeni is liable for any lack of conformity that exists at the time the goods were delivered and that becomes apparent within two years from delivery. If the goods are not in conformity, the Consumer is entitled to have the goods brought into conformity free of charge by repair or replacement. If repair or replacement is not possible, the Consumer may request a price reduction or rescission of the contract.
This warranty does not cover defects resulting from misuse, neglect, or improper handling by the Consumer.
12. Governing Law
These Terms of Service are governed by Dutch law. Any disputes arising out of or in connection with these Terms of Service shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
